3. Eligibility and Website Use

By using our website or services, you confirm that you are legally able to enter into a binding agreement under the laws applicable to you.
You agree not to:

  • Use our website for unlawful, fraudulent, or misleading purposes.
  • Attempt to gain unauthorized access to our website, systems, or accounts.
  • Upload or distribute malicious software, spam, or harmful content.
  • Copy, reproduce, or commercially exploit our website content without permission.
  • Violate another person’s intellectual property, privacy, or other legal rights.
  • Interfere with the security, functionality, or availability of our website.

We may restrict or suspend access where we reasonably believe these Terms have been violated.

4. Project Scope and Agreements

The work we provide will be based on the scope agreed upon before a project begins.
Any written quotation, proposal, statement of work, or service agreement may specify:

  • Project requirements and deliverables.
  • Pricing and payment milestones.
  • Estimated completion dates.
  • Included revisions and support.
  • Client responsibilities.
  • Additional services and associated fees.

Requests outside the agreed scope may require additional payment and a revised timeline. If these Terms conflict with a separately signed project agreement, the signed agreement will generally govern the specific project to the extent of the conflict.

5. Pricing and Payments

All service fees, payment schedules, deposits, and applicable taxes or other charges will be communicated before the relevant work begins.
Unless otherwise agreed in writing:

  • A project may begin after the required deposit or initial payment has been received.
  • Payments must be made according to the agreed invoice or payment schedule.
  • Work may be paused if a payment becomes overdue.
  • Payment delays may affect delivery dates.
  • Additional requests, third-party subscriptions, licenses, hosting, domains, or other expenses may be charged separately if they are not included in the agreed price.

You are responsible for reviewing invoices and providing accurate billing information. Any applicable taxes will be handled as required by the relevant law.

6. Project Timelines and Client Responsibilities

We will make reasonable efforts to complete projects within the estimated timelines agreed upon with you. Delivery dates may change because of technical issues, third-party delays, changes in project scope, or late client feedback.
You agree to provide the information, content, images, branding materials, account access, and approvals reasonably required to complete your project.
You are responsible for ensuring that materials you provide are accurate, lawful, and authorized for use. Delays in supplying materials or feedback may result in revised delivery dates or additional costs where applicable.

7. Revisions and Changes

The number and type of revisions included in a project will be determined by the applicable quotation or agreement.
A revision means a reasonable adjustment to work within the original agreed scope. A new design direction, additional functionality, extra pages, or other substantial changes may be treated as additional work.
We will communicate any additional charges or significant timeline changes before proceeding with out-of-scope work.

8. Intellectual Property Rights

All content, logos, trademarks, text, graphics, designs, software, and other materials displayed on our website belong to Muzammal Digital Solution or their respective owners unless otherwise stated.
You may not reproduce, distribute, modify, or commercially exploit our website materials without prior written permission.
For client projects:

  • Materials supplied by the client remain the property of the client or their respective rights holders.
  • Our pre-existing tools, methods, reusable code, frameworks, templates, and know-how remain ours or their respective owners’ property.
  • Ownership or usage rights for final project deliverables will be determined by the written project agreement.
  • Where the agreement provides for transfer of ownership after full payment, that transfer will take effect according to the agreement and applicable law.
  • Third-party themes, plugins, fonts, stock images, software, and other licensed materials remain subject to their respective license terms.
  • Editable source files, working files, or additional assets are included only when agreed upon in writing.

You confirm that you have the necessary rights and permissions for any materials you provide to us.

9. Third-Party Services and Platforms

Our services may involve third-party platforms or providers, including hosting companies, domain registrars, payment processors, advertising networks, social media platforms, analytics tools, plugins, and software providers.
These third parties operate under their own terms, policies, and privacy practices. We do not control their systems, pricing, availability, decisions, or changes.
Unless expressly agreed in writing or required by law, we are not responsible for disruptions, account suspensions, policy changes, price increases, or technical issues caused by third-party services.

10. Digital Marketing and Results Disclaimer

Digital marketing, SEO, paid advertising, social media management, and related services depend on many factors outside our control.
We do not guarantee specific search rankings, website traffic, sales, leads, advertising performance, revenue, or business growth unless a specific measurable commitment is expressly included in a written agreement.
You remain responsible for your business decisions, products, services, pricing, customer relationships, and compliance with advertising platform rules.
Advertising budgets and third-party platform fees are separate from our service fees unless explicitly stated otherwise.

11. Website Maintenance and Support

Maintenance, updates, backups, security monitoring, and ongoing support are included only when specified in your service agreement or package.
Work requested outside an active support or maintenance agreement may incur additional charges.
We recommend that clients maintain appropriate backups, protect account credentials, and keep their software and third-party licenses up to date. We will communicate any specific maintenance arrangements agreed upon for a project.

12. Cancellations and Refunds

Cancellation and refund requests are handled according to our applicable Return and Refund Policy, the relevant project agreement, and applicable law.
Because digital services may involve customized work, time, research, design, development, and other resources, charges for work already completed may not be refundable to the extent permitted by law.
If a project is cancelled, the client may be responsible for approved work completed, committed expenses, and other amounts payable under the project agreement.
Any eligible refund will be assessed according to the applicable policy and agreement. Nothing in this section limits consumer rights that cannot legally be waived.

13. Confidentiality and Data Protection

We take reasonable steps to protect confidential information shared with us during a project.
You should not send sensitive information unless it is necessary for the services and an appropriate method of transfer has been agreed upon.
Our collection and use of personal information are described in our Privacy Policy. By using our website or services, you acknowledge that you should review that policy.
Both parties should take reasonable precautions to protect passwords, account access, business information, and other confidential materials.

14. Portfolio and Promotional Use

Unless otherwise agreed in writing, we may request permission to display completed public-facing work in our portfolio, case studies, or promotional materials.
We will not intentionally publish confidential information or private client data as part of such materials. If your project requires confidentiality or must not be displayed publicly, please agree on those restrictions with us in writing before work begins.

15. Warranties and Disclaimers

We aim to provide our services with reasonable care and professionalism.
However, to the fullest extent permitted by applicable law, our website and any general information provided through it are offered on an “as available” basis. We do not guarantee that the website will always be uninterrupted, error-free, or compatible with every device, browser, platform, or third-party system.
Any specific warranties for a paid project must be stated in the relevant written agreement.
Nothing in these Terms excludes a warranty, right, or protection that cannot legally be excluded.

16. Limitation of Liability

To the fullest extent permitted by applicable law, Muzammal Digital Solution will not be liable for indirect or consequential losses, loss of profits, loss of business opportunities, loss of anticipated savings, or loss of data arising from the use of our website or services.
We are not responsible for losses caused by inaccurate client-provided materials, unauthorized changes made by others, client misuse, or third-party service failures, except where applicable law provides otherwise.
Where legally permitted, our total liability relating to a particular project will not exceed the amount paid to us for the specific services giving rise to the claim.
Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited, including any liability arising from fraud or other matters where such limitation is prohibited by law.

17. Indemnification

To the extent permitted by applicable law, you agree to be responsible for claims, losses, and reasonable costs arising from materials you supply, your unlawful use of our services, your infringement of third-party rights, or your material breach of these Terms.
This section does not apply to the extent a claim results from our own conduct for which liability cannot lawfully be excluded.

18. Suspension and Termination

Either party may terminate a project in accordance with the applicable written agreement.
We may suspend or terminate access to our website or services where reasonably necessary because of non-payment, unlawful activity, security risks, abusive conduct, or a material breach of these Terms.
Upon termination, outstanding payments for completed work and other amounts due under the applicable agreement remain payable. Any handover of deliverables, files, or account access will be handled according to the project agreement and applicable law.

19. Force Majeure

We will not be responsible for delays or failures caused by circumstances beyond our reasonable control, including natural disasters, power or internet outages, government actions, labor disputes, cyberattacks, widespread technical failures, or disruptions to third-party platforms.
We will make reasonable efforts to communicate significant delays and resume affected work when practical.

20. Changes to These Terms

We may update these Terms and Conditions from time to time to reflect changes in our services, business practices, or legal obligations.
The updated version will be published on this page with a revised “Last Updated” date. Changes will apply as permitted by applicable law. A separate written agreement may continue to govern an existing project where required by its terms.
We encourage you to review this page periodically.

21. Governing Law and Disputes

These Terms and Conditions are subject to applicable law. Any dispute will be addressed in accordance with the governing-law and dispute-resolution provisions of an applicable written agreement or, where none exists, the law and forum determined to apply to the matter.
Nothing in this section removes any mandatory legal rights or protections available to you.
